Terms of Service

These terms govern your access to Image Canvas, including accounts, AI image generation, credits, and acceptable use.

1. Acceptance of these terms

By accessing or using Image Canvas, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. If you use Image Canvas for an organization, you confirm that you have authority to bind that organization.

2. Eligibility and accounts

You must be legally able to enter into these terms and meet the minimum age required in your location. You are responsible for accurate account information, activity under your account, and keeping sign-in links and API tokens secure. Notify us promptly of suspected unauthorized use.

3. The service

Image Canvas lets you submit prompts and reference materials to generate, edit, organize, compare, and download images. Features, supported models, limits, and credit costs may change as the service evolves. We may impose reasonable usage and security limits.

4. Credits, payments, and refunds

  • Prices, currency, credit amounts, and applicable terms are shown before checkout. Payments are processed by Creem.
  • Credits are a limited, non-transferable service entitlement, have no cash value, and may be used only within Image Canvas.
  • Generation costs are shown in the product. Failed or cancelled generations are refunded automatically when our records confirm no successful generation.
  • Except where required by law or stated at checkout, completed credit purchases are non-refundable. Contact support if you believe a charge or credit balance is incorrect.

5. Acceptable Use Policy — prohibited content

You must not use Image Canvas to request, create, upload, edit, store, or share prohibited content. The following is expressly forbidden:

  • NSFW, adult, pornographic, sexually explicit, sexually exploitative, or sexually oriented content of any kind, including AI-generated content.
  • Any sexualized content involving minors, persons presented as minors, or age-ambiguous persons; child sexual abuse material; grooming; or sexual exploitation.
  • Face swaps, deepfakes, non-consensual intimate imagery, or deceptive face manipulation involving a real person.
  • Content that facilitates illegal activity, exploitation, human trafficking, terrorism, severe violence, harassment, hateful abuse, privacy invasion, fraud, or infringement of intellectual-property rights.
  • Attempts to bypass safety systems, conceal a prohibited request, automate abusive traffic, probe the service for prohibited outputs, or use generated content in violation of applicable law.

6. Content moderation and enforcement

Every user-supplied generation prompt is screened through Creem's Content Moderation API before it can reach an image model. Decisions marked flag or deny are blocked. If moderation is unavailable, generation is temporarily blocked rather than allowed through.

We may reject prompts, remove content, limit features, suspend or terminate accounts, preserve evidence, and report conduct when reasonably necessary to enforce these terms, protect users, or comply with law. You may contact support if you believe a decision was made in error.

7. Your content and permissions

You retain any rights you already hold in content you submit. You confirm that you have all rights and permissions needed to submit that content and request the intended processing. You grant us and our service providers a limited license to host, copy, transmit, modify, and process content solely to operate, secure, and improve the service and fulfill your requests.

AI outputs may be inaccurate, unexpected, similar to outputs provided to others, or ineligible for intellectual-property protection. You are responsible for reviewing outputs and ensuring your use complies with law and third-party rights.

8. Intellectual property

Image Canvas, its software, branding, interface, and service content are owned by us or our licensors. These terms do not grant you ownership of the service. You may not copy, reverse engineer, resell, disrupt, or access the service except as permitted by law or a written agreement.

9. Availability and termination

The service may change, experience interruptions, or discontinue features. You may stop using Image Canvas at any time. We may restrict or terminate access for violations, security risk, legal requirements, non-payment, or material harm to the service or others.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law, Image Canvas is provided “as is” and “as available” without warranties of uninterrupted operation, fitness for a particular purpose, non-infringement, or output accuracy. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or business opportunities. Rights that cannot legally be excluded remain unaffected.

11. Changes and contact

We may update these terms to reflect product, legal, or safety changes. We will post the revised terms and update the date above. Continued use after an update means you accept the revised terms where permitted by law. Contact the support email below with questions or disputes.
